Mehta said in his ruling on August 5th.<\/span><\/p><p><span style=\"font-weight: 400;\">Out of context, the decision feels like a conclusive end to Google. But there\u2019s nuance and complexity that deserves attention before determining an appropriate punishment.<\/span><\/p><p><span style=\"font-weight: 400;\">The DOJ needed to prove that:<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">\u201cGeneral search services\u201d is a market that can be monopolized.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Exclusivity deals with 3rd parties to make Google the default search engine were anticompetitive.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Being the default search engine was a major advantage due to the <\/span><i><span style=\"font-weight: 400;\">status-quo bias<\/span><\/i><span style=\"font-weight: 400;\"> and <\/span><i><span style=\"font-weight: 400;\">choice architecture<\/span><\/i><span style=\"font-weight: 400;\">.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The advantage in data and users from being the default search engine led to a distinct advantage in building a superior search engine.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Google needs real consequences. Only removing the exclusivity deals doesn\u2019t fix the decades of user data they leveraged to build a superior search engine.<\/span><\/li><\/ul><p><span style=\"font-weight: 400;\">The scope of this trial has been expansive. It encapsulates billions of dollars, multiple Fortune 50 companies, and a complicated economic ecosystem.\u00a0<\/span><\/p><p><a href=\"https:\/\/www.tn.gov\/content\/dam\/tn\/attorneygeneral\/documents\/pr\/2024\/pr24-59-Google.pdf\"><span style=\"font-weight: 400;\">Judge Mehta\u2019s 277-page opinion<\/span><\/a><span style=\"font-weight: 400;\"> is comprehensive, logical, and transparent\u2013even if it lacks remedies that will be proposed on Sept. 6th.<\/span><\/p><p><span style=\"font-weight: 400;\">Let\u2019s examine the skeleton of this trial, how Judge Metha came to his decision, and the behavioral economic principle\u2013status quo bias\u2013that serves as the foundation of the verdict.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-c23b01b elementor-widget elementor-widget-heading\" data-id=\"c23b01b\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Breaking Down the DOJ v. Antitrust suits need a specific purpose.<\/span><\/p><p><span style=\"font-weight: 400;\">In this case, Google was accused of violating the <\/span><a href=\"https:\/\/en.wikipedia.org\/wiki\/Sherman_Antitrust_Act\"><span style=\"font-weight: 400;\">Sherman Antitrust Act<\/span><\/a><span style=\"font-weight: 400;\"> which prohibits anticompetitive agreements.\u00a0<\/span><\/p><p><b>Sidenote<\/b><span style=\"font-weight: 400;\">: <\/span><i><span style=\"font-weight: 400;\">For the purposes of this article, I am not going to address the ads side of this trial since it\u2019s less relevant to Organic Search.<\/span><\/i><\/p><p><span style=\"font-weight: 400;\">To argue that Google\u2019s monopoly power in the general search service market and that their exclusivity deals were anti-competitive, the DOJ needed to establish that:\u00a0<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">\u201cGeneral search services\u201d are a relevant product market and alternative sources for consumer searches, like specialized vertical providers (SVPs) and social media sites, are not adequate substitutes.\u00a0<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Google\u2019s exclusivity deals created a barrier to entry that prevented competitors from scaling and diminished the incentive to invest in innovation in general search.<\/span><\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-a6bf3f7 elementor-widget elementor-widget-heading\" data-id=\"a6bf3f7\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Google\u2019s Monopoly Power in the General Search Services Market<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-4fe59ef elementor-widget elementor-widget-text-editor\" data-id=\"4fe59ef\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">The DOJ argued that Google holds monopoly power in the general search services market through market share and natural barriers to entry for competitors.<\/span><\/p><p><span style=\"font-weight: 400;\">Judge Metha was convinced that \u201cgeneral search services\u201d are a relevant product market and only directly compete with other general search engines (like Bing and DuckDuckGO). It would cost Apple, at least $20 billion to launch a competitive search engine, more to maintain and monetize it.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"2\"><b>Control of Key Distribution Channels:<\/b><span style=\"font-weight: 400;\"> Google\u2019s contracts and ownership of key platforms like Chrome make it financially unfeasible for competitors to secure similar deals.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"2\"><b>Brand Dominance:<\/b><span style=\"font-weight: 400;\"> &#8220;Google&#8221; is so ingrained in popular culture that it\u2019s used as a verb, driving even Bing users to search for \u201cgoogle.com.\u201d This brand power incentivizes partners to keep Google as the default search engine.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"2\"><b>Scale:<\/b><span style=\"font-weight: 400;\"> Data at scale significantly improves search result quality. Google to improve its product with more user behavior and query-type insights. Google exploits those scale advantages by leveraging user behavior data (via Chrome) and insights from an expansive query universe.<\/span><\/li><\/ul><p><span style=\"font-weight: 400;\">Judge Mehta agreed with the merits of the argument and dismissed Google\u2019s counterarguments which consisted of:<\/span><\/p><p><strong>Counterargument 1:<\/strong><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\"><em>Google<\/em>: DuckDuckGo and Neeva created competing products refuting the barrier to entry.\u00a0<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\"><em>Judge Mehta<\/em>: New entrants did not take significant market share from Google. While promising, it remains to be seen whether Perplexity can overcome the challenges that have faced other competitors and gain a foothold in a market where Google sets the standard.<\/span><\/p><p><span style=\"font-weight: 400;\">For most of us, Google isn\u2019t just the default\u2014it\u2019s the preferred choice. This preference is based on performance. Google\u2019s search engine delivers results that are often more comprehensive and tailored to what users are looking for. The speed and efficiency of Google\u2019s search algorithms set a high standard that other search engines have yet to meet consistently.<\/span><\/p><p><span style=\"font-weight: 400;\">Google argued that <\/span><a href=\"https:\/\/ipullrank.com\/tiktok-organic-search-potential\"><span style=\"font-weight: 400;\">younger people actually prefer TikTok<\/span><\/a><span style=\"font-weight: 400;\"> with 62% using it as their search engine. There was also the narrative last year that <\/span><a href=\"https:\/\/ipullrank.com\/reddit-seo\"><span style=\"font-weight: 400;\">billions of people were appending Reddit to their searches<\/span><\/a><span style=\"font-weight: 400;\"> (Reddit didn\u2019t replace Google in this instance).\u00a0<\/span><\/p><p><span style=\"font-weight: 400;\">Google used Apple Maps as another example, and for me it hits close to home. Despite Apple Maps being the default tool on CarPlay, I always choose to use Google Maps for driving directions. It\u2019s not driven by status quo bias, Google Maps offers a better user experience\u2014more accurate directions, better traffic data, and a more intuitive interface. Even though it requires effort to make the switch, the superior quality of Google Maps makes that effort worthwhile.<\/span><\/p><p><span style=\"font-weight: 400;\">Rangel&#8217;s testimony even acknowledged that the effectiveness of status quo bias can be tied to the quality of the product. When the default product is superior, the bias is stronger because users have less incentive to switch. When the default option is inferior, users are more likely to go through the friction to find something better.<\/span><\/p><p><span style=\"font-weight: 400;\">But the criticism of Google\u2019s declining quality hasn\u2019t impacted market share. At some point, it may. At that time, you\u2019d be able to make a stronger argument that the status quo bias isn\u2019t as critical to the competitive advantage.\u00a0<\/span><\/p><p><span style=\"font-weight: 400;\">Google\u2019s success is as much about delivering a superior product as it is about leveraging default settings.
